These Terms & Conditions govern your use of this website (“the site”), as well as any digital products, courses, sessions, or materials offered by Imaginative Art (c/o Kristen Phillips). By accessing or using this site or purchasing products through it, you agree to the terms below.

1. Use of This Website

This site and all associated content are intended for personal, non-commercial use. You agree not to use this site for unlawful or disruptive purposes, including attempts to interfere with site functionality or security.

2. Digital Products & Courses

Purchases of digital downloads, online courses, meditations, and other digital materials are non-refundable.

Upon purchase, you are granted a personal, non-transferable, non-exclusive license to access the materials. You may not:

  • share, distribute, or resell digital files

  • upload content to external platforms

  • reproduce or modify the material for commercial purposes

All digital products remain the intellectual property of Imaginative Art (c/o Kristen Phillips).

3. One-on-One Sessions

Scheduling and purchasing a 1:1 session indicates agreement with the following:

  • Cancellations or rescheduling requests must be made at least 24 hours in advance

  • Sessions canceled or missed with less than 24 hours notice are non-refundable

  • Refunds are not offered for missed or unattended sessions

  • If a session must be canceled by Imaginative Art, a reschedule or refund will be offered

Sessions provide creative, educational, and reflective guidance, not therapy, counseling, or medical treatment.

4. Payment Processing

Purchases made through this site are processed securely through third-party providers such as Squarespace Payments, Stripe, or PayPal.

Imaginative Art does not receive or store complete payment details (such as full credit card numbers). All payment processing is subject to the terms of the provider used at checkout.

5. Intellectual Property

All artwork, writing, images, meditations, PDFs, videos, digital products, and site content are the exclusive property of Imaginative Art (c/o Kristen Phillips), unless otherwise noted.

Users may not:

  • copy, reproduce, or modify any content

  • distribute or publish materials elsewhere

  • use content for commercial purposes

  • claim ownership of any work found on this site

Requests for written permission may be submitted via the contact information below.

6. Refund Policy

  • Digital products and online courses: Non-refundable

  • 1:1 sessions: Refunds are not offered unless Imaginative Art cancels the session

  • Workshops or live offerings: Refund policies may vary and will be noted at the time of purchase

These policies are in place due to the immediate nature of digital access and the scheduling commitments required for sessions.

7. Disclaimer

The services, courses, and materials offered through Imaginative Art are intended for creative, educational, and reflective purposes only.

They are not a substitute for professional:

  • medical care

  • mental health treatment

  • counseling

  • psychiatric care

  • emergency services

Users participate at their own discretion and are responsible for their own wellbeing while engaging with the material.

8. Limitation of Liability

To the fullest extent permitted by law, Imaginative Art (c/o Kristen Phillips) is not liable for:

  • any damages resulting from the use or inability to use digital products, courses, or services

  • any reliance placed on site content

  • any outcomes resulting from 1:1 sessions or creative guidance

Use of this site and its offerings is at your own risk.

This site may link to third-party platforms such as Instagram, Substack, Insight Timer, or payment processors. These platforms operate independently and are governed by their own terms and privacy policies.

Imaginative Art is not responsible for the content or practices of external sites.

10. Governing Law

These Terms & Conditions are governed by the laws of the State of Oregon, without regard to conflict of law principles.

Any disputes arising from use of this site or its products will be handled under Oregon jurisdiction.

These Terms & Conditions may be updated periodically. The “Last Updated” date will reflect the most recent revision.

Continued use of the site after changes are posted indicates acceptance of the updated terms.
